WAIVER AND RELEASE AGREEMENT

By purchasing a ticket and/or participating in a walking eco-tour provided by Sarasota Vortex Tours LLC (hereafter referred to as "the Operator"), I acknowledge and agree to the following terms. I fully understand that I am voluntarily assuming all risks associated with this activity and waive my right to sue the Operator for any injury, loss, or damage that may occur during my participation.

Assumption of Risk & Waiver of Liability

I acknowledge that participating in a walking eco-tour involves inherent risks, including but not limited to:

• Physical exertion, including walking on uneven terrain, loose sand, tree roots, low-hanging branches, and standing water.

• Exposure to wildlife, insects, and weather conditions that may change unexpectedly.

• The possibility of personal injury, illness (including communicable diseases such as COVID-19), property damage, or other unforeseen incidents.

 

I fully assume all risks associated with this activity and release the Operator, its staff, tour partners, and other participants from all liability, including claims arising from negligence. This release applies to personal injury, death, property damage, or loss sustained during or as a result of the tour. If I violate this agreement and attempt to bring legal action against the Operator, I agree to be responsible for all legal costs incurred by the Operator in defending such action.

 

Medical Treatment & Emergency Situations

I understand that the Operator does not provide medical coverage and will not be responsible for any medical expenses I may incur as a result of injury or illness during the tour. If I require emergency medical treatment, I authorize the Operator to arrange for medical care at my own expense. I certify that I have disclosed any relevant medical conditions that could impact my participation.

 

Participant Responsibilities & Compliance

I agree to:

• Follow all instructions given by the tour guide or staff at all times.

• Refrain from using drugs or alcohol before or during the tour to ensure my safety and that of others.

• Act responsibly and be mindful of environmental conservation efforts during the tour.

• Be financially responsible for any damage I cause to Operator property, staff, or equipment.

 

I understand that failure to comply with these terms may result in my removal from the tour without refund and could increase my risk of injury.

 

Cancellation, Refund, & Weather Policy

I acknowledge that the Operator has a strict cancellation and refund policy as outlined on its website. Tours are subject to cancellation due to inclement weather or other unforeseen circumstances. In such cases, the Operator will provide the option to reschedule or issue a credit at its discretion. The Operator is not responsible for delays, cancellations, or disruptions due to events beyond its control, including natural disasters, government actions, or public health emergencies.

 

Media Release

I grant Sarasota Vortex Tours LLC a worldwide, royalty-free license to use any photographs, videos, or other media taken during the tour for promotional and educational purposes.

 

Binding Agreement & Indemnification

I understand that this waiver is a legally binding agreement and that by signing it, I am waiving certain legal rights. I further agree to indemnify and hold harmless the Operator from any loss, liability, damage, or costs, including legal fees, arising from my participation in this activity. This waiver applies to me, my heirs, next of kin, executors, administrators, and assigns.
